This Medical Disclaimer forms an integral part of the Terms & Conditions of Vasuvo Care ("Company", "we", "our", "us") governing the Vasuvo mobile application ("App").
By accessing or using the App, you expressly acknowledge and agree to the terms below.

1. No Medical Service Whatsoever
The App is a non‑clinical, consumer‑operated digital reminder and connectivity tool. It is not a substitute for professional medical care, medical equipment, or clinical monitoring of any kind.
You acknowledge and agree that the Company:
- Does NOT provide medical advice or clinical guidance
- Does NOT practice medicine or provide medical diagnosis
- Does NOT provide nursing, caregiving, or attendant services
- Does NOT provide telemedicine, telehealth, or remote patient care
- Does NOT provide health monitoring, vital‑sign tracking, or clinical observation
- Does NOT provide emergency response, fall detection, or safety intervention services
2. Not a Medical Device
The App is a general wellness and reminder tool and is not a medical device or medical‑grade monitoring system. You acknowledge and agree that the App is not:
- A regulated medical device under FDA, CDSCO, or any other government authority
- A diagnostic tool or system
- A patient monitoring system
- A fall‑detection or emergency‑detection system
- A government‑certified, clinically validated, or medically approved product
3. No Duty of Care
You acknowledge and agree that the App is a general wellness and reminder tool and does not create any form of medical, supervisory, or professional duty of care:
- The Company owes no medical duty of care and does not provide medical, clinical, or professional healthcare services.
- The Company undertakes no obligation to monitor your health, physical condition, safety, or medication adherence.
- The Company assumes no responsibility to act on any alert, reminder, inactivity signal, or notification generated by the App.
- Use of the App does not create any fiduciary, medical, supervisory, or professional relationship between you and the Company, its founders, directors, employees, contractors, or affiliates.
4. No Reliance Clause
You agree that the App is a supplemental wellness and reminder tool only and must not be relied upon as your primary or sole method of medication management:
- You will not rely on the App as your sole medication management system.
- You are responsible for independently verifying all medication schedules, dosages, and timing.
- Missed, delayed, or undelivered reminders may occur at any time..
- Technical failures, device issues, connectivity problems, or notification errors are always possible.
5. Automation & Technology Failure Disclosure
The App depends on:
- Device hardware
- Operating system permissions
- Internet connectivity
- Third-party push notification systems
- Cloud infrastructure providers
Failures may occur due to:
- Device battery depletion
- Software bugs
- Server downtime
- Third-party service interruptions
- Force majeure events
6. No Emergency Functionality
The App is NOT designed, marketed, or intended for emergency detection, emergency monitoring, or emergency response of any kind. It is a general wellness and reminder tool and must not be relied upon in situations where immediate medical attention may be required.
Vasuvo Care does NOT:
- Monitor users in real time
- Detect medical emergencies, falls, or life‑threatening conditions
- Dispatch medical personnel or caregivers
- Contact emergency services or third parties on your behalf
- Guarantee delivery, timing, or accuracy of any notification
In the event of an emergency, you must contact local emergency services immediately.
Failure of the App to detect inactivity, health deterioration, or any other condition shall not create any liability for Vasuvo Care, its founders, directors, employees, contractors, or affiliates.
7. Caregiver Linking Disclaimer
The caregiver feature is a voluntary, user-controlled connection tool.
Vasuvo Care does NOT:
- Verify the identity, background, or qualifications of any caregiver
- Screen, monitor, or evaluate caregivers
- Supervise caregiver actions, decisions, or conduct
- Ensure caregiver availability, responsiveness, or reliability
- Mediate disputes between users and caregivers
Vasuvo Care is NOT liable for:
- Caregiver negligence, inaction, or failure to respond
- Delayed responses, misinterpretation, or misuse of shared information
- Any harm, loss, or dispute arising from caregiver interactions
- Consequences of sharing access or information with caregivers
8. User Data Accuracy Disclaimer
All medical and medication information is:
- All medical, health, and medication information displayed in the App is entered solely by users. Such information is not reviewed, validated, or verified by Vasuvo Care or by any medical professionals.
- Vasuvo Care makes no representations or warranties regarding the accuracy, completeness, reliability, or correctness of any user‑entered data. You are solely responsible for ensuring that all information you provide — including medication names, dosages, schedules, and health details — is accurate and up to date.
- Any insights, reminders, or notifications generated by the App are based entirely on the information you enter and may be inaccurate if the underlying data is incorrect.
The Company makes no representations regarding accuracy or completeness of user-entered information.
9. Assumption of Risk
By using the App, you expressly assume all risks associated with:
- Missed, delayed, or incorrect medication reminders
- Incorrect dosage information resulting from user input or device limitations
- Failure of inactivity or safety‑related detection features
- Worsening of health conditions or deterioration
- Hospitalization or emergency medical events
- Injury, accidents, or harm
- Serious health outcomes, including death
10. Maximum Limitation of Liability
To the maximum extent permitted by applicable Indian law, Vasuvo Care, its founders, directors, shareholders, employees, contractors, affiliates, and agents shall NOT be liable for:
- Any medical outcome or personal injury
- Wrongful death or emotional distress
- Consequential, indirect, special, or punitive damages
- Loss of profits or loss of data
- Claims arising from reliance on App insights, missed alerts, or data entry errors
📈 Total aggregate liability, if any, shall not exceed the total amount paid by you in VasuvoCare app, in the preceding 12 months.
ℹ️ If no payment was made, liability shall not exceed INR 1,000.
11. Indemnification
You agree to indemnify, defend, and hold harmless Vasuvo Care and its founders, directors, officers, and employees from and against any claims, actions, damages, liabilities, losses, costs, or legal expenses arising from:
- Your use or reliance on the App, its insights, or its notifications
- Any medical, health, or lifestyle decisions you make based on the App
- Claims brought by your family members, caregivers, or third parties
- Issues arising from missed, delayed, or undelivered alerts or notifications
- Misuse of the App, including incorrect data entry or unauthorized access
- Violation of these Terms or applicable laws
12. No Warranties
The App is provided strictly "AS IS" and "AS AVAILABLE."
The Company disclaims all warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Accuracy or reliability
- Continuous availability
- Non-infringement
13. Regulatory Disclaimer
The Vasuvo App is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease and does not fall under the definition of a medical device as per applicable Indian health regulations, including CDSCO guidelines.
14. Severability
If any provision of this Disclaimer is found to be invalid, unlawful, or unenforceable, that provision shall be deemed severed from the Disclaimer, and the remaining provisions shall continue to remain valid and enforceable to the fullest extent permitted by law.
