The App is a non-clinical, consumer-operated digital reminder and connectivity tool.
The Company:

- Does NOT provide telemedicine
- Does NOT provide health monitoring
- Does NOT provide emergency response services
2. Not a Medical Device
The App is not:
- A regulated medical device
- A diagnostic system
- A patient monitoring system
- A fall-detection system
- An FDA, CDSCO, or government-certified medical product
3. No Duty of Care
You acknowledge and agree that:
- The Company owes no medical duty of care.
- The Company undertakes no obligation to monitor your health.
- The Company assumes no responsibility to act on any alert or inactivity signal.
- Use of the App does not create any fiduciary, medical, or supervisory obligation.
4. No Reliance Clause
You agree that:
- You will not rely on the App as your sole medication management system.
- You will independently verify all medication schedules.
- You understand that missed reminders may occur.
- You understand that technical failures are possible at any time.
5. Automation & Technology Failure Disclosure
The App depends on:
- Device hardware
- Operating system permissions
- Internet connectivity
- Third-party push notification systems
- Cloud infrastructure providers
Failures may occur due to:
- Device battery depletion
- Software bugs
- Server downtime
- Third-party service interruptions
- Force majeure events
6. No Emergency Functionality
The App is NOT designed, marketed, or intended for emergency detection or emergency response.
The Company:
- Does not monitor users in real-time
- Does not dispatch medical assistance
- Does not contact emergency services
In case of emergency, contact local emergency services immediately.
Failure of the App to detect or notify inactivity shall not create liability.
7. Caregiver Linking Disclaimer
The caregiver feature is a voluntary, user-controlled connection tool.
The Company:
- Does not verify caregiver identity
- Does not screen caregivers
- Does not supervise caregiver conduct
- Does not ensure caregiver responsiveness
The Company is not liable for:
- Caregiver negligence or failure to respond
- Delayed response or misuse of information
- Disputes between users
8. User Data Accuracy Disclaimer
All medical and medication information is:
- Entered solely by users
- Not reviewed by medical professionals
- Not verified by the Company
The Company makes no representations regarding accuracy or completeness of user-entered information.
9. Assumption of Risk
By using the App, you expressly assume all risks associated with:
- Missed medication
- Incorrect dosage reminders
- Inactivity detection failure
- Health deterioration
- Hospitalization
- Injury
- Death
10. Maximum Limitation of Liability
To the maximum extent permitted by applicable Indian law, Vasuvo HealthTech Pvt Ltd, its founders, directors, shareholders, employees, contractors, affiliates, and agents shall NOT be liable for:
- Any medical outcome or personal injury
- Wrongful death or emotional distress
- Consequential, indirect, special, or punitive damages
- Loss of profits or loss of data
📈 Total aggregate liability, if any, shall not exceed the total amount paid by you in the preceding 12 months.
ℹ️ If no payment was made, liability shall not exceed INR 1,000.
11. Indemnification (Litigation Shield)
You agree to indemnify, defend, and hold harmless Vasuvo HealthTech Pvt Ltd and its founders, directors, officers, and employees from and against any claims, actions, damages, liabilities, losses, costs, or legal expenses arising from:
- Your reliance on the App
- Your medical decisions
- Claims brought by family members, caregivers, or third parties
- Disputes arising from missed alerts
- Misuse of the App
12. No Warranties
The App is provided strictly "AS IS" and "AS AVAILABLE."
The Company disclaims all warranties, express or implied, including:
- Merchantability
- Fitness for a particular purpose
- Accuracy or reliability
- Continuous availability
- Non-infringement
13. Regulatory Disclaimer
The App is not intended to be regulated as a medical device under applicable Indian health regulations.
14. Severability
